This book seeks to set the record straight by examining how patent systems came to be shaped by contending interests in different stages of production chains. The authors argue that patent systems are inherently imperfect, as they reflect the efforts of competing parties to exploit economic surplus. The more valuable the potential surplus, the more extreme these efforts become. In the case of US-style patent systems, which have dominated other methods of encouraging inventive activity, the key factor is the creation of a temporary property right that can be traded in a market. This approach facilitates a decentralized ecology of inventors and firms, allowing them to transfer technological knowledge and extend the frontiers of what is economically possible.
